Abstract
This study investigates the constitutional tension between judicial determinations—particularly a guilty ruling reversed and remanded—and the expression of democratic will through election. It assesses whether a candidate under such legal status can legitimately exercise presidential authority, and what constitutional doctrines apply in balancing the rule of law with electoral sovereignty. The paper offers a normative framework to address this conflict, aiming to reinforce both legal integrity and democratic legitimacy.
